Public Offer

for the Sale of Electronic Gift Certificates for Photographer Services

Hereby, Alexander Grigorievich Abramov, TIN 502 728 417 245, acting as a taxpayer under the self-employed taxation regime (hereinafter — the “Seller”), in accordance with Clause 2 of Article 437 of the Civil Code of the Russian Federation, offers an unlimited number of persons to enter into a contract for the purchase and sale of electronic gift certificates under the terms set forth below (the “Public Offer”).

Acceptance of this Offer shall constitute the conclusion of a contract between the Parties under the terms of this Offer (Clause 1 of Article 433 of the Civil Code of the Russian Federation).

1. Definitions

1.1. Electronic Gift Certificate — a digital image confirming the holder’s right to receive photographer services in the scope specified in the certificate.

1.2. Acceptance of the Offer — full and unconditional acceptance of the terms of the Offer by paying for the certificate through the designated payment services.

1.3. Contract — the purchase and sale agreement for an electronic gift certificate concluded between the Seller and the Buyer.

1.4. Website — the online resource containing information about the Seller and the conditions for purchasing the certificate, located at alexandcamera.com.

1.5. Buyer — a person purchasing a certificate from the Seller.

2. Subject of the Contract

2.1. The Seller undertakes to provide the Buyer with an electronic gift certificate for photographer services, and the Buyer undertakes to pay for it in accordance with the terms of this Contract.

2.2. The certificate is provided as a digital image file (JPEG/PNG) and is delivered to the Buyer via direct message in the Telegram messenger.

2.3. Upon presentation of the certificate, its holder acquires the right to receive photographer services in the specified scope.

3. Procedure for Purchasing and Delivering the Certificate

3.1. Payment is made in Russian rubles via the YooMoney payment system (bank cards, Faster Payments System, SberPay, T-Pay).

3.2. The moment of payment is deemed to be the moment funds are credited to the Seller’s account.

3.3. Delivery of the certificate is carried out electronically within 1 (one) to 24 (twenty-four) hours from confirmation of payment.

3.4. Delivery is made by sending the certificate image in a direct message to the Buyer’s Telegram account.

4. Intellectual Property and Copyright

4.1. The Seller is the author and the holder of exclusive and personal non-property rights to the results of the photography session that may be provided under the certificate.

4.2. All photographs received under the certificate are provided to the Buyer under a simple (non-exclusive) license for personal, non-commercial use, including publication on the Internet.

4.3. Publication of works is permitted only with attribution of the author’s name, unless otherwise agreed between the parties.

4.4. Modifications of photographs (cropping, filters, retouching) are allowed only with the Seller’s consent.

5. Fees

5.1. The price of the certificate is indicated on the Seller’s website or agreed upon individually with the Buyer.

5.2. The cost of services provided under the certificate is included in its price.

6. Returns and Exchanges

6.1. The Buyer has the right to request a refund within 14 (fourteen) days from the date of payment.

6.2. To request a refund, the Buyer must send an email to work@alexandcamera.com, attaching the payment receipt and the Telegram username to which the certificate was sent.

6.3. Refunds are processed within 10 business days from the date of receiving the request.

7. Liability of the Parties

7.1. The Seller is not liable for the inability to use the certificate for reasons beyond the Seller’s control (loss of data, refusal by the holder, etc.).

7.2. All disputes shall be resolved through negotiations, and if this is not possible, through court proceedings in accordance with the legislation of the Russian Federation.

8. Personal Data and Confidentiality

8.1. The Buyer consents to the processing of personal data by the Seller in accordance with Federal Law No. 152-FZ, including: • first and last name; • email address; • Telegram username and contact information; • phone number.

8.2. Personal data is processed for the purposes of identification, certificate delivery, provision of services, communication with the Buyer, and processing refunds.

8.3. The Seller undertakes not to disclose personal data to third parties except as required by law.

8.4. The Buyer has the right to withdraw consent to the processing of personal data by submitting a written request to the Seller’s email address.

9. Miscellaneous

9.1. The Contract is deemed concluded from the moment of acceptance of the Offer and remains in force until all obligations have been fulfilled by the Parties.

9.2. All notifications and agreements may be made via messengers, social networks, or email.

9.3. Electronic correspondence is legally binding for the Parties.
